Let???s look at both sides of the Pre-Paid Legal Services scam story. To start, we have the company???s legal services they offer to members. Secondly, let???s look at the business opportunity the company provides.

Pre-Paid Legal Services Inc. is a 39 year old publicly traded company (NYSE: PPL) that provides subscription-based legal plans and services to over 1.5 million customers across the U.S. and Canada. In June 2011, Pre-Paid was acquired by Mid Ocean Partners, a privately held corporation headquartered in New York. The company changed its name to Legal Shield after the acquisition.

The new corporate name for the company is said to be part of an overall re-branding initiative following the acquisition of Prepaid Legal.

In the months following the takeover, the company???s mission remains ???to provide outstanding legal service by quality law firms at an affordable price???. Legal Shield currently has 50 independent provider law firms across the U.S. and Canada. Attorneys??? services include letter writing and telephone calls on members??? behalf; document and contract reviews; identity theft protection; trial defense; IRS audit defense; 24 hour emergency services; review or preparation of wills; traffic court representation; home foreclosure protection.

Various riders are available including a legal shield rider; a home business rider, and a corporate record keeping option.

The average monthly fee for customers to have an attorney ???on retainer??? is $26. The legal plans start at $17 for an individual or family with additional identity theft protection added for $10 per month. Additional plans can also be purchased for small to medium sized businesses for under $50 per month.

In the last decade, courtroom and regulation issues within Pre-Paid Legal itself have sprung up in the states of Wyoming, Missouri, and Oklahoma. In 2001, the Wyoming Attorney General issued a press release stating When we discovered that Pre-Paid was using prohibited income representations to promote their multilevel marketing program, we warned them that the representations were prohibited by Wyoming law. Pre-Paid Legal made financial restitution to settle the claims. Since 2001 in Missouri, the company has settled law suits with similar claims, some of which they have won and lost.

The U.S. Securities and Exchange Commission (SEC) forced the company to stop counting the commissions they paid out to sales associates as assets, instead of expenses in 2001. In 2009, the Federal Trade Commission (FTC) alleged some of Pre-Paid s program descriptions and related materials were misleading representations, express or implied.

The FTC???s three year investigation ended in 2010 without any action.

So if you are serious about starting your own business, you can put aside any concerns that that Pre-Paid Legal is a scam. It has withstood rigorous courtroom and regulatory scrutiny and remains a well-respected company with outstanding services at affordable rates.

Before you plunge in and sign up as a sales associate for the company, consider how you are going to promote your business. Write out your marketing plan. How are you going to advertise and promote the legal services? Pre-Paid Legal began using network marketing (multi-level marketing or MLM) as a sales model in 1983.
